NY Hospitals Face Class Action Over Medical Record Fees

According to a Law360 report, several New York hospitals and an information services company are at the center of a class-action lawsuit alleging they engaged in price fixing in the production of patient medical records. When the hospitals receive a request for their patients’ records, they are required to produce the records, but can — subject to state law, as well as the Health Insurance Portability and Accountability Act (HIPAA) — charge a fee. However, healthcare providers or an information service company may NOT profit from the production of records. In a recent lawsuit, the three hospitals and the copying company are alleged to have turned a profit of approximately $7,000,000.00 last year from this practice alone. The class action claims that patients were overcharged as much as 50 cents per page.
